Data Protection

Any individual has the right to request a copy of personal information that we hold on them.  When such a subject access request is received, we are required to provide the following information:

 

  • A description of the personal data, the purposes for which we process it, and those to whom the data may be disclosed.  We should also supply details of the source of the data, except where that would identify another individual.

 

  • All the information which forms the personal data record.

 

  • Where a decision is taken by fully automated means, the logic employed in coming to the decision.

 

Where the data record includes personal data on another individual, we should not disclose this information unless:

 

  • The other individual has consented, or

 

  • It is reasonable in all the circumstances to comply with the request without consent.  For instance, the Data Protection Commission has advised that it is reasonable to disclose the name of a member of staff which is contained within the personal data record, unless there is a significant risk to the member of staff in doing so.

 

We are required to respond promptly to such a request, and in not more than forty days (not working days).  We can charge a fee of up to £10 for the disclosure of this information.

 

In addition to the right of access, data subjects also have the following rights in relation to the processing of their personal data:

 

  • The right to prevent the processing of personal data which is likely to cause damage or distress.

 

  • The right to prevent processing for the purpose of direct marketing.

 

  • Certain rights in relation to decision-making using fully-automated means.

 

  • An individual may apply for a court order requiring us to rectify, block erase or destroy any inaccurate data.

 

Any Individual can ask the Information Commissioner to make an assessment of whether specific processing of personal data is being carried out in compliance with the Act.
